A resale flat comes with history: earlier owners, earlier agreements, a housing society, and sometimes a home loan that is still running. A gap anywhere in that history can hold up your loan, your society membership or your registration.
Legal Assure handles the legal side of the deal, from the first document check to the last name transfer, for buyers, sellers and NRIs across Pune and PCMC.
Our advocates review the papers, explain the findings in plain words and prepare the documents your bank and the Sub-Registrar will ask for.
We trace ownership through earlier agreements and Sub-Registrar records to confirm the seller can pass a clear title, and share a written title search report.
We check the OC, approvals, society records, tax receipts and papers for gaps that could stall your loan or registration. See property verification.
We draft or review the token-stage agreement to sale: price, payment schedule, handover date and exit terms. Franking is included.
An advocate-drafted sale deed with an accurate property description and seller covenants, prepared to suit your lender’s requirements.
We calculate stamp duty and fees, book the Sub-Registrar appointment and guide both parties through sale deed registration.
Through our housing loan desk we connect you with partner banks for a resale home loan and coordinate the legal papers the bank asks for.
After registration we help transfer the society share certificate and the name on property tax, MSEDCL electricity and piped gas records.

Stamp duty is charged on the agreement value or the ready reckoner value, whichever is higher. Within Pune city limits it currently totals about 7% for men and 6% for women, including metro cess and local body surcharge. The registration fee is 1%, capped at ₹30,000. Rates vary by location, so we confirm the exact amount for your property before you pay.
Yes, this is common. The seller’s bank issues a letter showing the amount outstanding, and part of your payment or your loan disbursement is used to close it. The bank then releases the original documents with a closure letter. We set out this sequence in the agreement and check the closure before handover.
Under the model bye-laws most Maharashtra housing societies follow, a member does not need the society’s NOC to sell. Banks usually ask for a society letter confirming membership and no dues, and the share certificate transfer needs a formal application. We help you get these letters in time.
